　　时值第22个职业病防治法宣传周，专业人士呼吁，适时、灵活调整《职业病分类和目录》，适当简化职业病职工工伤认定程序，更好地保障劳动者的职业健康权益。

　　4月25日至5月1日，是我国第22个职业病防治法宣传周。眼下，聚焦提升劳动者职业健康素养和保障职业健康权益，各地开展形式多样的宣传活动。

　　“颈椎病、腰背痛算职业病吗？”“已经诊断为职业病了，为何难以认定工伤？”“技术、工艺推陈出新，职业病病谱会不会随之变化？”说起职业病，有劳动者提出疑问，也有劳动者饱受困扰。

　　对此，有专业人士向记者表示，随着经济转型升级，新的工种和劳动方式不断产生，劳动者接触的职业环境和职业危害更加复杂多样，应适时、灵活调整《职业病分类和目录》，适当简化职业病职工工伤认定程序，更好地保障劳动者的职业健康。

　　颈椎病能纳入职业病目录吗

　　记者采访发现，包括司机在内的不少上班族呼吁，将颈椎病、肩周炎、“鼠标手”等疾病纳入职业病目录。“因工受伤”的江师傅就是其中一员。

　　江师傅在深圳开出租车近20年，由于久坐，患上颈椎病、腰椎间盘突出，“从业15年以上的，多多少少都有这些毛病，很难避免。”

　　“每天坐在车上12个小时，有时下车时，两条腿都是麻的，腰也特别累。”江师傅说，颈椎病犯病时，双肩麻木，头疼得厉害；腰椎间盘突出时，轻则疼痛，重则难以起身。

　　针对不少劳动者将颈椎病、腰椎病等列入职业病目录的呼声，中国劳动关系学院安全工程学院副院长、教授任国友直言：“将肌肉骨骼性疾病纳入职业病目录是一个积极的举措，但目前缺乏可操作的鉴定疾病因工作引起的技术手段，需要科学、谨慎地推进。”

　　广东华商(龙岗)律师事务所高级合伙人管铁流告诉记者，要将肌肉骨骼性疾病等纳入职业病目录，诊断会是一个大问题。“确诊职业病需要确定疾病与工作的因果关系，证明日常生活中不存在其他危害因素。另外，即使能确诊职业病，后续的伤残等级评定也不好开展。”

　　“更重要的是，一旦确诊职业病，再就业必然会受影响。”管铁流坦言，职业病防治法规定，用人单位对不适宜继续从事原工作的职业病病人，应当调离原岗位，并妥善安置。“多数职业病造成的损害是不可逆的，而肌肉骨骼性疾病是可逆的。另外，职业病诊断书全国联网，若确诊颈椎病、腰椎病列为职业病，那确诊为职业病的职工将被调离岗位，甚至未来都很难从事原岗位工作。”

　　工伤认定程序能否适当简化

　　“没想到，我的工伤认定卡在劳动关系确认上。”自20世纪90年代初开始，华先生在河北省张家口市某金矿挖矿。2014年，因感觉肺部不适，华先生寻求职业病诊断。然而，被诊断为职业病后，他却因无法证明劳动关系而没能被认定工伤。至今，仍未能享受工伤待遇。

　　记者了解到，2005年，华先生所工作的金矿系集体企业，且现已破产，改制为矿业公司。他继续在原址挖矿，当年底辞职。

　　2016年9月，职业病诊断机构出具诊断证明书，确认华先生为职业性尘肺病，但用人单位是集体金矿，并非改制后的矿业公司。2019年5月，他申请劳动仲裁，请求确认与矿业公司在2005年存在劳动关系，没有被受理。他起诉到法院后，法院判决确认双方于矿业公司成立后至华先生离职前存在劳动关系。

　　然而，华先生申报工伤时，因职业病诊断证明用人单位系破产前的集体企业，当地人社部门以该金矿已破产并被注销为由决定不予受理。无奈之下，华先生只能再次向当地职业病诊断机构申请职业病诊断，请求其将用人单位变更为矿业公司。机构明确表示无法再次诊断，且变更用人单位须矿业公司盖章确认同意。

　　2023年，华先生以矿业公司为用人单位申报工伤，未获人社部门受理。为此，他再次提起诉讼……

　　“历时近10年、累讼数10次，因劳动关系、用人单位确认等问题，导致工伤认定无法完成，职业病保障、工伤待遇无法享受。”管铁流认为，问题根源在于患职业病的职工进行工伤认定时，必须确认与用人单位存在劳动关系。

　　管铁流透露，华先生的遭遇不是个例，一些职工被诊断为职业病后，后续进行工伤认定时常常卡在证明劳动关系上。而职业病不同于一般由机械性外力导致的工伤，大多有潜伏期，需要持续甚至终身治疗。

　　“职业病因职业活动引起。有职业史、接触史且有临床表现，足以确诊职业病。因此，特定的劳动关系便不构成是否认定工伤的决定性要素。如此一来，再证明存在劳动关系，给劳动者认定工伤带来困难。”管铁流呼吁，程序能否适当简化。同时，建议劳动者要及早了解工作岗位是否接触职业病危害因素，如遇到复杂用工关系或用人单位主体变更等情况，应有意识地保存与工作相关的证据。

　　建立职业病目录动态更新机制

　　记者梳理发现，自1957年我国首次发布《关于试行“职业病范围和职业病患者处理办法”的规定》以来，职业病目录进行了3次调整，疾病种类也从14种增至10类132种。最近一次调整是在2013年。

　　当前，新技术、新材料、新工艺不断更新，新职业、新工种和新业态不断产生，一些新的职业危害因素开始出现。

　　“随着新材料的广泛应用，劳动者可能接触到的新型化学物质增多，部分物质可能对人体产生潜在危害。”任国友举例道，电磁辐射、非电离辐射等物理因素的危害逐渐显现，新兴行业如生物医药、基因编辑等，或使劳动者接触到新型生物危害因素，如病毒、细菌等。

　　任国友认为，职业病目录既要保持一定的稳定性，又要建立动态更新机制，让目录更灵活、适用，建议重点关注新产生的职业危害因素，评估其对职工健康的影响，并及时将相关疾病纳入目录中。

　　对此，管铁流亦有同感。针对新的职业病危害因素，他建议职业病目录补充开放性条款，“比如，当前目录中关于职业性化学中毒的开放性条款——上述条目未提及的与职业有害因素接触之间存在直接因果联系的其他化学中毒。”

　　如何提升职业病目录的灵活性？任国友认为，应强化科学性和专业性，及时发现和评估新的职业病危害因素，进一步完善目录动态调整机制，以更好地适应不断变化的职业环境。同时，建立职业病监测和预警系统，提供及时、准确的信息支持。(工人日报 记者 刘友婷)
